Terms of Service

These terms govern your use of the White Beam Concepts website. Paid design, production, and installation work is governed by a separate written quote or service agreement when we take on a project.

These Terms of Service (“Terms”) apply to access and use of http://whitebeamconcepts.com and general online interactions with us. Separate written quotations, proposals, purchase orders, or service agreements (each a “Service Agreement”) govern specific projects. If there is a conflict, the Service Agreement prevails for that project. This page is practical website terms for visitors and prospects; have Ghanaian counsel review commercial contracts before major engagements.

1. Acceptance of terms

By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

If you use the Site on behalf of a company or other organisation, you represent that you have authority to bind that organisation to these Terms.

2. About our website and services

The Site describes our capabilities, portfolio, blog content, and contact channels. Content is for general information only. It does not constitute a binding offer, quote, or warranty unless confirmed in writing by White Beam Concepts.

Services we typically provide include (without limitation):

  • Design and corporate identity;
  • Advertising and outdoor media (signage, billboards, vehicle branding, and related work);
  • Commercial printing;
  • Photography;
  • Laser engraving and cutting;
  • CNC routing;
  • Related production, finishing, and installation where agreed.

Availability depends on capacity, materials, location, and a confirmed brief.

3. Enquiries and contact form

When you submit the contact form or send an enquiry:

  1. You confirm the information is accurate and that you are authorised to share it;
  2. You agree we may contact you by email, phone, or other details you provide;
  3. Submitting an enquiry does not create a contract for paid work until both parties agree terms (for example an accepted quotation, signed order, or clear written confirmation);
  4. We may refuse, ignore, or delay responses to abusive, unlawful, spam, or incomplete enquiries;
  5. Automated rate limits and spam filters may temporarily block repeated submissions.

4. Intellectual property

4.1 Website content

Unless otherwise stated, all content on the Site (text, graphics, logos, photographs, videos, layouts, icons, and brand materials) is owned by White Beam Concepts or used under licence. You may not copy, scrape, republish, reverse engineer, or commercially exploit Site content without our prior written consent, except for:

  • Temporary caching or display needed to view the Site in a browser;
  • Fair dealing / fair use as permitted by applicable copyright law;
  • Sharing links to public pages of the Site.

4.2 Portfolio and client marks

Client names, logos, and project images appear to illustrate past work. Third-party trademarks remain the property of their owners. Display on our Site does not imply ongoing endorsement unless stated.

4.3 Project deliverables (client work)

Ownership and licence terms for design files, artwork, prints, signage, and other deliverables are set out in the applicable Service Agreement or quotation. Unless otherwise agreed in writing (aligned with common creative agency practice):

  • We retain ownership of pre-existing tools, methods, templates, source files, and know-how;
  • Upon full payment, the client receives the usage rights described in the quotation (for example final artwork for the agreed media);
  • Unpaid concepts, drafts, unused options, and proposals remain our property;
  • We may reasonably showcase completed public-facing work in our portfolio and marketing unless the client has a written confidentiality restriction or NDA;
  • Third-party assets (stock photos, fonts, licensed materials) remain subject to their own licence terms; the client is responsible for ongoing licences where required;
  • Clients retain ownership of materials they supply to us (logos, copy, images) and grant us a licence to use them to perform the agreed work.

5. Acceptable use of the Site

You agree not to:

  • Use the Site in any way that violates Ghanaian or applicable law;
  • Attempt to gain unauthorised access to servers, forms, or data;
  • Overwhelm the Site with automated requests, scrapers, or spam;
  • Upload or transmit malware, or interfere with Site security;
  • Impersonate any person or misrepresent your affiliation;
  • Harvest personal data of other users from the Site;
  • Use Site content to train machine-learning models or bulk datasets without permission;
  • Post or send unlawful, defamatory, harassing, or infringing material through any contact channel.

We may suspend access, block IP addresses, or take legal action where we reasonably believe these rules have been broken.

6. Quotes, pricing, and project terms (summary)

The following apply unless a Service Agreement says otherwise:

  1. Quotes are estimates based on the brief provided and remain valid only for the period stated (or 30 days if none is stated);
  2. Changes to scope, materials, quantity, artwork, location, or timeline may adjust price and delivery date;
  3. Client-supplied assets must be accurate and rights-cleared; the client indemnifies us against claims arising from materials they supply;
  4. Approvals: production or print that proceeds after client approval of proofs is at the client’s risk regarding approved content errors;
  5. Lead times are estimates; force majeure, supply shortages, weather (for outdoor install), and third-party delays may affect schedules;
  6. Payment: deposits and final payment schedules are as stated on the invoice or quote; late payment may pause work and may attract reasonable recovery costs;
  7. Storage of goods: finished goods not collected or installed within a reasonable time after notice may incur storage charges or, after further notice, disposal or resale rights as allowed by law;
  8. Warranty: we warrant workmanship consistent with industry standards for the materials and process used; we do not warrant third-party materials beyond the manufacturer’s warranty, or misuse, vandalism, weather extremes outside specification, or improper maintenance by others.

Detailed commercial terms should always be confirmed in writing before production.

7. Outdoor advertising, installation, and site work

Where work involves outdoor media, vehicle branding, or on-site installation:

  • The client is responsible for obtaining landlord, municipal, highway, or building management permits unless we expressly agree to arrange them;
  • Safe site access, power, parking, and security coordination may be required from the client;
  • Weather and structural conditions can delay or alter installation methods;
  • Risk of loss in installed outdoor assets after handover typically passes to the client as set out in the Service Agreement.

8. Disclaimer of warranties (website)

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties regarding the Site, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by Ghanaian law:

  1. We are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, goodwill, or business opportunity arising from Site use or inability to use the Site;
  2. Our total liability arising out of Site use is limited to GHS 500 or the amount you paid us (if any) specifically for website-related paid features in the 12 months before the claim, whichever is greater;
  3. Nothing in these Terms excludes liability that cannot be excluded by law (for example fraud or death/personal injury caused by negligence where such exclusion is prohibited);
  4. For paid project work, liability caps and remedies are governed by the Service Agreement / quotation, not solely these website Terms.

10. Indemnity

You agree to indemnify and hold harmless White Beam Concepts and its directors, staff, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your misuse of the Site;
  • Your breach of these Terms;
  • Content or materials you supply to us that infringe third-party rights or applicable law;
  • Your failure to obtain required permits or approvals for work you commission, where that was your responsibility.

11. myOwn Ghana and other properties

Links to myOwn Ghana or other related brands are for convenience. Use of myOwn is subject to myOwn’s own terms, privacy policy, and checkout rules. White Beam Concepts is not automatically liable for independent third-party ecommerce transactions solely because of a link from this Site.

12. Electronic communications

You consent to receive communications from us electronically (email, Site notices, or other digital means) regarding your enquiries, projects, and legal notices related to the Site. Electronic communications satisfy any legal requirement that such communications be in writing, to the extent permitted by law.

13. Changes to the Site and Terms

We may modify or discontinue any part of the Site at any time. We may update these Terms by posting a revised version with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance of the updated Terms, except where mandatory law requires additional consent.

14. Governing law and disputes

These Terms and any dispute arising from Site use are governed by the laws of the Republic of Ghana, without regard to conflict-of-law rules that would apply another jurisdiction’s laws.

Parties will first attempt to resolve disputes in good faith through negotiation. If unresolved, disputes shall be submitted to the competent courts of Tema / Accra, Ghana, unless mandatory consumer protections in your country require otherwise for individuals acting as consumers.

15. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any Service Agreement for specific work, form the entire agreement between you and us regarding Site use and supersede prior informal understandings on that subject.
